The brand and brand names

The whole story began in 2002...

I, Zsófia Marton, brought my horse Madonna Csillag back from severe lameness with the help of medicinal herbs.

 

In the beginning, I wrote newspaper articles on the subject, and I prepared my thesis at Gödöllő University of Agricultural Sciences under the title "Usage of medicinal plants in horse feeding", which I defended with honors in 2004.

 

Then in 2005, in addition to my national feed reference work at the time, I wrote the book a LÓHERBA- Medicinal Plants for Horses. In many cases, I typed the lines at the Brussels airport, after a tiring European Commission meeting.

 

In view of the great interest, I gave online advice for years, then I prepared the LÓHERBA recipes and handed them over to a wholesaler, who started distributing the products under this name. Although these were rudimentary recipes, they still helped many riders.

 

A few years later, my husband, Károly Szabolcsi, decided to allow me to deal with this topic full time. At the suggestion of a dear friend of ours, the horse breeder Andrea Janászik, we chose the name FitoCavallo® as the brand name. Not long after, at the suggestion of another dear friend of ours, Nóra Lenner, we associated the name FitoCanini® with the dog product.

At that time, the influence of Traditional Chinese Veterinary Medicine on the recipes was already decisive, which greatly increased the effectiveness of our products. In the meantime, we also named our webshop, which is how Fito-store was created (fito=plant, store=store).

 

Years later, we protected the FitoCavallo®, FitoCanini® and Lóherba® brand names to avoid possible abuse. After all, the name is binding, and we put our whole heart and soul into what these brand names cover.

Trademark protection

The brand names "FitoCanini®", "FitoCavallo®" and "Lóherba®" are under trademark protection.

 

Unauthorized use of the trademarks "FitoCanini®", "FitoCavallo®", "Lóherba®" registered by the National Office of Intellectual Property is prohibited by law.

 

Trademark protection gives exclusive rights to the holder (owner) of the trademark. Anyone who violates these exclusive rights commits trademark infringement.

 

Among the legal consequences of trademark infringement, according to § 388 of the Penal Code, whoever imitates or takes over the trademark without authorization, or puts into circulation goods/services produced by imitating or taking over the trademark, or puts such goods/services into circulation by acquiring or keeping it for the purpose of production, it infringes the rights of the trademark owner resulting from protection and thus causes financial disadvantage.

In serious cases, the punishment for a crime can be imprisonment of up to ten years.
